Details of the US Supreme Court appeal The appeal filed by the state of Delaware was against a federal appeals court decision that limited Delaware to parlay sports betting on the NFL (National Football League). This was originally a part of the state’s plans to widen the reach of legalized sports betting. The federal appeals court decided that the state of Delaware can only implement a sports lottery if it’s similar to the parlay type of betting on the NFL that was previously offered by Delaware in 1976. Currently, Delaware is exempted from the 1992 federal ban on sports betting. This is because Delaware is one of the few states that had some kind of sports betting system being implemented even before the ban was declared. Impact of Delaware’s case to New Jersey’s issue This decision on Delaware’s case can have a negative effect on New Jersey’s case. New Jersey also made a similar move when they filed a lawsuit against the US government, stating that the 1992 federal ban on sports betting is unconstitutional. New Jersey further claimed that this ban is an infringement of the states’ constitutional rights. The people behind New Jersey’s case aims to provide 11 casinos in Atlantic city with a competitive position by legalizing sports betting. There is no official statement yet from The Casino Association of New Jersey, but Senator Ray Lesniak have several reasons to think positive. According to Lesniak, he was happy that Delaware lost the case. This was because Delaware’s case involves the interpretation of the law. New Jersey’s case, on the other hand, challenges the law because it is unconstitutional. Lesniak also added that New Jersey offered to help Delaware in its case, since both states have made similar moves. However, Delaware did not accept New Jersey’s offer.
